HomeTeams Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the HomeTeams mobile application, website, and services (collectively, the "Service"). HomeTeams is provided by Brae Applications, LLC ("Brae Applications," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.
1. Overview of the Service
HomeTeams, operated by Brae Applications, LLC (“HomeTeams,” “we,” “us,” or “our”), provides a digital coordination platform designed to help individuals, families, and care teams organize communication, tasks, and support across daily life and health-related activities.
HomeTeams is not a healthcare provider, does not practice medicine, and does not provide medical diagnosis, treatment, or clinical services.
2. Nature of the Platform
HomeTeams functions as: (a) a coordination and communication platform, (b) an organizational and informational system, and (c) a facilitator of connections between users and third-party services.
HomeTeams does not control, direct, or supervise any third-party services or user interactions.
3. AI and Automated Features
HomeTeams may provide AI-driven tools, including but not limited to “CoachAI,” to assist with organization, communication, and general informational support.
By using these features, you acknowledge: (a) AI-generated outputs may be incomplete, inaccurate, or outdated, (b) AI outputs are provided for informational purposes only, (c) AI outputs do not constitute medical, legal, or professional advice, and (d) you are solely responsible for decisions made based on AI-generated content.
4. Nurse Access and Health Guidance
HomeTeams may provide access to nurse call services or similar health-related resources.
You acknowledge and agree: (a) these services are for general guidance and informational support only, (b) they do not constitute medical advice, diagnosis, or treatment, (c) use of these services does not establish a provider-patient relationship, and (d) HomeTeams does not employ or control these providers unless explicitly stated.
Emergency Disclaimer:
Do not use HomeTeams for emergencies. If you are experiencing a medical emergency, call 911 immediately.
5. Third-Party Services
HomeTeams may facilitate access to third-party services, including:
Nurses or healthcare-related resources
Paid helpers or service providers
External platforms and integrations
HomeTeams:
Does not guarantee the quality, safety, or legality of these services
Is not responsible for outcomes or interactions
Is not a party to agreements between users and third parties
6. Subscriptions, Fees, and Billing
a. Subscription Plans
Certain features of HomeTeams are offered on a subscription basis. By subscribing, you agree:
Subscriptions automatically renew unless canceled prior to the renewal date
You authorize recurring charges to your selected payment method
b. Usage-Based Services
Certain services (e.g., nurse calls) may be billed per use.
c. Cancellation
You may cancel your subscription at any time through the App or by contacting support. Cancellation will take effect at the end of the current billing cycle unless otherwise stated.
d. Refunds
All payments are non-refundable unless required by law or explicitly stated.
e. Pricing Changes
We reserve the right to modify pricing with reasonable notice.
f. Usage Thresholds and Feature Limitations
Certain features of HomeTeams may be offered on a limited or introductory basis. Access to these features may be subject to usage thresholds, including but not limited to:
Number of actions, tasks, or interactions
Access to AI-generated features
Use of communication or coordination tools
Access to nurse or third-party services
Once a user exceeds applicable thresholds:
Continued access to such features may require subscription activation or upgrade
Certain features may be restricted, limited, or disabled until an applicable plan is selected
HomeTeams reserves the right to:
Modify usage thresholds at any time
Introduce new feature limitations
Adjust which features are included in free or paid tiers
Where required by law, we will provide reasonable notice of material changes.
g. Feature Availability
Not all features are available on all plans. HomeTeams may, at its discretion:
Add or remove features from any plan
Reclassify features between free and paid tiers
Modify availability based on user behavior, usage, or system needs
7. Accounts and User Responsibilities
You are responsible for: (a) maintaining the confidentiality of your account, (b) ensuring accuracy of information, and (c) using the platform lawfully and ethically.
8. Data and Regulatory Status
HomeTeams is not a covered entity or business associate under HIPAA.
By using the Service:
You acknowledge that information shared may not be protected under HIPAA
You agree to exercise discretion when sharing sensitive health information
9. User Content
You retain ownership of your content but grant HomeTeams a limited license to use it for providing and improving the Service.
10. Disclaimers
The Service is provided “as is” without warranty of any kind.
HomeTeams disclaims all warranties, including: (a) accuracy of AI outputs, (b) reliance on Coach AI, (c) outcomes from third-party services, and (d) availability or reliability of the platform.
11. Limitation of Liability
To the fullest extent permitted by law, Brae Applications shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses. Our total liability for any claim shall not exceed $100 or the amount you paid for the Service in the 12 months preceding the claim, whichever is greater.
12. Indemnification
You agree to indemnify and hold harmless Brae Applications and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of applicable laws or regulations.
13. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the State of Washington, without regard to conflict of laws principles. Any disputes arising from these Terms or the Service shall be resolved exclusively through binding arbitration in Benton County, Washington. By using the Service, you waive your right to participate in a class action lawsuit or class-wide arbitration.
14. Changes to Terms
We may modify these Terms at any time. We will provide notice of significant changes by updating the date at the top of the Terms and, if required by law, by providing additional notice.
